ALUREX LIMITED THREE YEAR SURFACE PROTECTION WARRANTY
(Etching & Staining Coverage Only — Restricted and Conditional Obligations)
(Coverage can be extended by certified installer indefinitely)
1. Scope of Limited Warranty
ALUREX (“MarbleSeal Distribution”) hereby provides the original purchasing party (“End
User”) with a non-transferable, non-assignable, and limited warranty (“Warranty”) for a
period not to exceed twenty-four (24) consecutive months from the recorded date of
product application (“Warranty Term”). This Warranty exclusively pertains to chemical
etching and non-mechanical staining occurring on natural-stone substrates treated with
the ALUREX coating system, provided such conditions arise solely from ordinary residential use and not from any excluded circumstances enumerated herein.
2. Covered Conditions
Subject strictly to the limitations, procedural requirements, exclusions, and obligations
contained within this Warranty, the Manufacturer agrees to, at its sole election, (a) perform a localized reapplication, (b) conduct a spot-level restorative treatment, or (c) implement a partial surface refinishing procedure in response to verified instances of:
(a) Acid-induced etching resulting exclusively from incidental exposure to weak household
acids; and (b) Pigment-based staining caused by non-abrasive, non-corrosive agents that fall within normal domestic environmental conditions. No other performance characteristics, deficiencies, or surface phenomena are covered. 3. Excluded Conditions (Non-Exhaustive) This Warranty expressly excludes, but is not limited to, the following:
• Mechanical abrasions, scratches, gouges, cuts, impacts, or surface impressions resulting from physical force, tools, utensils, or objects.
• Thermal shock, heat damage, scorch marks, micro-crazing, or discoloration arising
from exposure to cookware, appliances, or any item exceeding ambient
temperature.
• Damage caused by alkaline agents, acidic compounds exceeding typical household
pH ranges, abrasive chemicals, steam, solvents, or cleaning agents not explicitly
sanctioned under the ALUREX Maintenance Protocol.
• Any aesthetic variance including gloss reduction, textural inconsistency, matte
disruption, reflectivity changes, coating wear patterns, or perceived dulling.
• Substrate movement, fabrication defects, installation errors, fissures, natural stone
veining irregularities, porosity inconsistencies, or inherent mineral behaviors.
• Any condition arising from negligence, misuse, improper maintenance, non-
standard cleaning practices, unapproved restoration attempts, or failure to adhere
strictly to maintenance guidelines.
4. Conditions Precedent to Warranty Eligibility
The End User must fulfill all the following in order for any claim to be processed or
considered:
1. Provide written notice within seven (7) calendar days of initial observation of the
alleged defect.
2. Produce proof of purchase, proof of application date, and evidence of continuous
compliance with ALUREX-approved maintenance requirements.
3. Permit Manufacturer or its designated agent unrestricted access to inspect the
surface in situations.
4. Refrain from altering, modifying, or attempting to remedy the aYected area before
inspection.
Failure to satisfy any condition precedent shall automatically void the Warranty in its
entirety.
5. Manufacturer’s Remedies and Limitations
The Manufacturer’s obligation shall be strictly limited to one of the following remedies,
chosen solely at the Manufacturer’s discretion:
• Localized repair;
• Partial coating reapplication;
• Surface-level restorative action.
Under no circumstance shall Manufacturer be obligated to replace stone, remove
installations, compensate for loss of use, provide refunds, or address consequential or
incidental damages.
6. Disclaimer of Additional Warranties
This Warranty constitutes the exclusive warranty applicable to the ALUREX product.
Manufacturer expressly disclaims all other warranties, whether express, implied,
statutory, or otherwise, including but not limited to implied warranties of merchantability,
fitness for a particular purpose, or durability beyond the Warranty Term. No representative,
technician, installer, distributor, or agent is authorized to modify, expand, reinterpret, or
waive any term herein.
7. Limitation of Liability
Manufacturer’s liability shall never exceed the cost of the original ALUREX coating
application. Under no circumstance shall Manufacturer be liable for:
• Removal or reinstallation of stone;
• Labor costs associated with third parties;
• Structural, aesthetic, functional, or collateral losses;
• Any damages indirectly or incidentally related to etching or staining.
8. Governing Law & Jurisdiction
This Warranty shall be governed exclusively by the laws of the state in which the original
application was performed. Any disputes, claims, or actions arising under this Warranty
shall be subject to binding arbitration conducted in the same state, and the End User
expressly waives any right to initiate or participate in class-action proceedings.
9. Entire Agreement
This document constitutes the full, final, and exclusive statement of the Warranty between
Manufacturer and End User. No oral or written statements outside this document shall be
considered part of the Warranty terms.
